    Overtime laws by state (2026)

    The federal Fair Labor Standards Act (FLSA) requires 1.5x pay for hours over 40 in a workweek for non-exempt employees. Several states add daily overtime, double-time, or 7th-day rules on top.

    Federal baseline (FLSA)

    • 1.5x regular rate for hours over 40 per workweek
    • Applies to non-exempt employees (most hourly workers)
    • No federal daily overtime
    • Workweek is any fixed, recurring 168-hour period the employer sets

    States with extra overtime rules

    Alaska

    1.5x after 8 hrs/day or 40 hrs/week.

    California

    Double-time rules

    1.5x after 8 hrs/day or 40 hrs/week. 2x after 12 hrs/day and after 8 hrs on the 7th consecutive workday.

    Colorado

    1.5x after 12 hrs/day, 12 consecutive hrs, or 40 hrs/week - whichever gives the employee more pay.

    Nevada

    1.5x after 8 hrs/day for employees making less than 1.5x minimum wage; 40 hrs/week otherwise.

    40 hrs/week standard. Special daily-OT rules in manufacturing establishments after 10 hrs/day.
